Terms of Service

Please read these Terms of Service carefully before using Afflemi. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Afflemi ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. These Terms apply to all users of the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Description of Service

Afflemi is a public directory of affiliate programs, affiliate networks, and the software and agencies used in affiliate marketing, and a place where affiliates and brands find each other. The Service allows you to:

  • Browse and compare listings without an account
  • As an affiliate, create a free profile and appear on the affiliate board
  • As a brand, submit a listing for a program, network, tool or agency you own or are authorised to represent, for a one-time fee
  • As a brand approved for Recruit, find affiliates and contact them, for a one-time fee
  • Track your listings, profile and applications from your dashboard

Listings are written by the vendors who submit them and checked by us for plausibility before publication. We do not verify commission rates, prices or other commercial terms beyond what is publicly visible on the vendor's website, and those terms can change without our knowledge. Confirm terms with the vendor before relying on them.

Afflemi is not a party to any agreement between an affiliate and a brand. We don't guarantee that an affiliate will join a program or that a brand will accept an affiliate, and we take no share of any commission.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. User Accounts

To use the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not share your account credentials with others or allow others to access your account. You are fully responsible for all activities that occur under your account, whether or not authorized by you.

Each account is either an affiliate account or a brand account, chosen when you sign up, and the type can't be changed later. To use the other side of the Service, sign up again with a different email address.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Submit a listing for something you do not own or are not authorised to represent
  • Enter false, misleading, or fraudulent information in a listing, including commission terms, prices or claims about the product
  • Add a website to an affiliate profile that you do not own or control, or enter false information in a profile, including visit ranges
  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service to engage in or promote illegal activities
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
  • Use the Service to transmit viruses, malware, or other malicious code
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use automated scripts or bots to abuse the Service or circumvent its intended use
  • Scrape or collect data from the Service for competitive purposes or to build a similar service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Remove, obscure, or alter any proprietary notices on the Service

We reserve the right to investigate and take appropriate legal action against anyone who violates this provision, including removing content and terminating accounts.

5. Affiliate Profiles

Affiliate profiles are free. By creating one, you confirm that:

  • You own or control every website you add, and you confirmed it with the code we gave you
  • The information in your profile, including your monthly visit ranges, is accurate to the best of your knowledge
  • Brands approved for Recruit may see your name, websites, contact email and the programs you promote when they unlock your profile, and may email you about their programs

We may hide or remove a profile that breaks these Terms, lists websites its owner doesn't control, or that we believe is false. You can hide your profile or ask us to delete it at any time. Whether to join any program a brand offers you is entirely up to you.

6. Brands and Recruit

6.1 Applying

Recruit is open to brands we approve. We review every application by hand and may approve, decline, or later revoke access at our discretion, for example if we cannot confirm that you represent the company you named. Applying is free; you are only charged if we approve you and you subscribe.

6.2 Using Affiliate Details

Affiliate details you see through Recruit, including names, websites and email addresses, are shared with you only so you can contact those affiliates about affiliate or partner programs you run or manage. You agree not to:

  • Scrape, copy in bulk, export or download affiliate data, by hand or with automated tools
  • Sell, rent, share or give affiliate details to anyone else
  • Add affiliates to mailing lists, or send them anything unrelated to your programs
  • Keep contacting an affiliate who has asked you to stop
  • Let anyone outside your company use your account or your unlocks

If you break these rules, we may revoke your Recruit access and close your account without a refund.

7. Payment Terms

7.1 Listing Fee

Each listing carries a one-time fee, shown at the time of payment. The fee covers review and, if accepted, publication of that one listing for as long as the directory operates. There is no recurring charge and no automatic renewal.

7.2 Recruit

Recruit is a one-time payment at the price shown when you buy it, available once we have approved your application. There is no subscription and no automatic renewal. Each calendar month includes the number of profile unlocks shown on our brands page, reset on the first day of the month; unused unlocks don't carry over. Recruit payments are non-refundable.

Recruit includes up to three listings with no listing fee; they are reviewed like any other listing. Recruit doesn't expire, but we may end it, without a refund, for a brand that breaks these Terms, for example by misusing affiliates' details. If it ends or the payment is refunded, you keep one of the included listings for good (the one you choose, or your oldest if you don't); the others are taken offline unless you pay the one-time listing fee for each. Listings you paid the one-time fee for are not affected.

7.3 Payment Processing

All payments are processed securely through Lemon Squeezy, our third-party payment processor. We do not store your complete payment information on our servers. By providing payment information, you agree to Lemon Squeezy's terms of service and privacy policy.

7.4 Review and Refunds

New listings are reviewed before payment. Sending a listing for review is free and does not guarantee publication. If we approve it, the listing is published once you pay the fee; if we decline it, nothing is charged. If we ask for changes and you do not make them within 30 days, we may decline the listing.

A claim on an existing listing is paid for first and then confirmed. If we cannot confirm a claim, we refund the fee in full. Once a listing is published or a claim confirmed, the fee is not refundable.

7.5 Removal

We may remove a published listing if it becomes inaccurate, if the product or program shuts down, or if it breaches these Terms. You may ask us to remove your own listing at any time. Removal after publication does not entitle you to a refund.

8. Intellectual Property

8.1 Our Rights

The Service and its original content, features, functionality, and visual design are owned by Afflemi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

8.2 Your Rights

You retain all rights to the listings, profile details and other content you enter into the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you.

8.3 Aggregated Data

We may use aggregated, anonymized data derived from your use of the Service for analytical purposes, service improvement, and research. This data will not identify you.

9. Service Availability

While we strive to provide reliable service, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service is provided "as is" and "as available" without warranties of any kind.

We may perform scheduled maintenance that temporarily interrupts access to the Service. We will attempt to provide advance notice of scheduled maintenance when possible. We are not responsible for any loss or damage resulting from service interruptions.

10. Third-Party Services and Links

The Service contains links to third-party websites and affiliate programs that are not owned or controlled by Afflemi. We have no control over and assume no responsibility for the content, terms, commission accuracy, or practices of any affiliate program, brand, affiliate or third-party website. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with your participation in any affiliate program, or any dealings between affiliates and brands, that you found through the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you:

  • Breach these Terms of Service
  • Violate applicable laws or regulations
  • Engage in fraudulent or abusive behavior
  • Submit listings that repeatedly breach the acceptable use policy
  • Misuse affiliate details you see through Recruit

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may also terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon account deletion, we will delete your data in accordance with our Privacy Policy.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AFFLEMI AND ITS LICENSORS AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) ANY COMMISSION, PAYOUT, TRAFFIC, OR OTHER FIGURES YOU ENTER OR VIEW IN THE SERVICE ARE ACCURATE OR RELIABLE, OR (iv) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY AFFILIATE PROGRAM'S ACTUAL TERMS DIRECTLY WITH THAT PROGRAM.

13. Limitation of Liability

IN NO EVENT SHALL AFFLEMI OR ITS LICENSORS AND SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, MISSED PAYOUTS, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service, including affiliate program information you or another user entered
  • Unauthorized access, use, or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

14. Indemnification

You agree to defend, indemnify, and hold harmless Afflemi from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights or the terms of any affiliate program you join or run

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Afflemi regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter.
